Autism Speaks’ ING DIRECT Ride Now Philadelphia Sunday, September 28, 2008 By entering and participating in Autism Speaks’ ING DIRECT Ride Now Philadelphia motorcycle ride (the “Ride”), I represent to Autism Speaks (Ride Presenter) and any person or entity involved in the sponsorship (Co-Sponsor), and conduct of the Ride including any volunteers (Ride Organizer), that I understand and agree as follows: 1. I knowingly and voluntarily accept the risks and hazards inherent in the operation of a motorcycle on public streets and facilities, including all risk of property damage and injury including death. I understand that I am solely responsible for the safe operation of the motorcycle, for evaluating the road and traffic conditions and for riding in an appropriate manner given the circumstances. 2. I am of at least 18 years of age and I am duly licensed and competent to operate a motorcycle in a safe manner and my motorcycle is in safe operating condition. I agree not to consume any alcoholic beverages during the day before all riding is complete for that day. I agree to refrain from the use of any illegal drugs or controlled substances during this event. I certify that I have the minimum required vehicle insurance as required by law. I also agree to obey all laws, exercise all safety precautions, avoid littering and respect the property of others. 3. I do not knowingly have any mental or physical condition that may interfere with the safe operation of my motorcycle. I understand that I alone am responsible for my personal health and safety, and the personal property I bring with me. 4. I assume the potential risks in participating in a motorcycle event, including, but not limited to, falling, contact with other participants, traffic conditions on and around the ride course, the condition of the ride course, and the impact of weather (including high heat and humidity). 5. I am medically able to participate and will abide by any decision of any Ride official, before or during the Ride, relative to my ability to safely participate. I agree that my failure to honestly represent my ability to participate in the Ride or accept the conditions of participation as stated herein, may result in my disqualification from participation. 6. My entry fees are non-refundable and my participation in the Ride is non-transferable. 7. I hereby grant permission for my name, likeness, and voice to be used by the Ride Presenter, any of the Co-Sponsors, and/or Ride Organizer for any legitimate purpose in any media now or hereinafter developed. Having read and agreed to the conditions of participation as contained within this Release, and knowing the truthfulness of the information that I have disclosed on this form, in consideration of the acceptance of this application, I, for myself and anyone entitled to act on my behalf, waive and release and agree to indemnify and hold harmless the Ride Presenter, each and every Co-Sponsor, and Ride Organizer including without limitation ING DIRECT,and all representatives and agents of the foregoing, from any and all claims or liabilities of any kind arising in connection with my participation in the Ride even though that liability may arise out of negligence or carelessness of any such party. I understand that this means I agree not to sue any and all of the released parties in connection with the Ride.
